This is a skill error by Anders Lee. Problem for Lee is his skill error made pretty good contact with Gunnarsson's head.
Just because it is a skill error doesn't mean the offending player should get away without a suspension, first offense or not.
I do not think there was any intent to collect Gunnarsson in the head, they were both heading to the boards to get the puck, however that elbow cannot get up that high and collect a player in the head, the league has said it wants to protect the head, this fine of $2286.29 is not expressing that desire.
If the NHL 'lose' their current class action and have to pay compensation to ex-players and their families we may see a change due to the financial ramifications, until then I think we are going to be seeing incidents like this barely punished.
